The County Attorney has filed an apparently unauthorized notice of appeal, presumably purely on the word of County Administrator Chuck Huckelberry, or on the initiative of the County Attorney's office itself.

Only the Board of Supervisors has the authority to decide whether to appeal the court's ruling, and they haven't yet met to make any decision on the matter.

Tuesday morning we will present affidavits and letters from renowned computer scientists and election integrity activists stating that releasing these databases cannot harm national security as Chuck Huckelberry and his lawyers claim.

There are some 800 databases going back to May of 1998. Making them public could prove our votes were NOT counted inaccurately. If there is no problem, what is Pima County afraid of? Could these databases and audit logs prove the County committed election fraud?

The Democrats have also taken issue with several of Judge Miller's findings of fact as not supported by the testimony, and some of his conclusions of law as erroneous. See Democrats Motion to Amend for more details.

Bill Risner make a powerful case that Judge Miller would be hard-pressed to ignore that the Judge quite simply got several points wrong in his under-advisement opinion.

Discussion of the lawsuit will be one of the very first items on the agenda, so try to at the Board's Chambers by 9 am.

Douglas A. Kellner has served as Co-Chair of the New York State Board of Elections since 2005. Prior to serving on the New York State Board, Doug served as a commissioner on the New York City Board of Elections from 1993 to 2005. Commissioner Kellner has been an outspoken advocate for improving the voting process in New York while insisting on transparency, verifiability, accuracy and uniformity in voting procedures.

This Sunday, January 13, 2 - 4pm Central ( 4 - 5 Pacific) we will "Focus on New Hampshire"

The New Hampshire primary on Tuesday, January 8th, has created a reverberating series of stories pointing to possible, even likely election fraud, and both major parties may have been affected.

We will have on as our returning guests Jim Condit Jr. and Walter Reddy, who launched the Primary Monitoring website, www.libertybroadcastnetwork.org just a couple of days before the Iowa Caucus and who were monitoring the New Hampshire primary. Walter was "on the ground" in New Hampshire, and they each have interesting data to contribute.

Also calling in will be VoteRescuer Gregory Gory who was a citizen monitor in New Hampshire, videotaping events of interest.

We will be welcoming callers in between or at the end of interviews. Anyone who was in New Hampshire as a citizen monitor or a voter, who has a New Hampshire story of interest, is especially welcome to call in.

Items related to the New Hampshire primary that we'll be discussing:

* Bev Harris's discovery from Sutton County Town Clerk about the "OOPS! Ron Paul actually got 31 votes, not zero!" and her research turning up the criminal history of one of the principals of LHS, the company that programmed all the Diebold machines in New Hampshire (which counted 81% of the votes)

* Statistical analysis by Election Defense Alliance's Bruce O'Dell, and Theron Horton, of percentages won by Obama and Hillary - the curious comparison of the numbers between the hand-counted "towns" and the Diebold opscanned counted "towns"

* Discussion of YouTube videos - possible manipulation of vote total reporting by media

Part I: Rep. Holt describes how emergency bill can help avert 2008 election disaster

U.S. Congressman Holt this week will introduce an emergency bill (see fundamental provisions below) that he says will address the lack of hand-marked paper ballots in certain states including Pennsylvania. As it stands, in disputed elections in some areas, the only figures available are what comes out of the machines. Will this bill avoid a repeat of the nightmare scenarios of Ohio and Florida in Pennsylvania and many other paperless states?

According to Rep. Holt, the bill gives counties the option to replace paperless DREs with hand-marked paper ballots and gives them the funding to do so. Officials and activists who support the bill fear it may be weakened (radically rewritten) in committee, while others believe the measure doesn't go far enough or too far Will it be changed significantly in committee? Can it pass in time? Who supports/opposes...why? .What about DREs with paper?

Part 2: Was the 2008 New Hampshire Primary Stolen?

Dr. Steve Freeman, author of "Was the 2004 Election Stolen?" will discuss the controversies surrounding the January 4 New Hampshire primary. Dr. Freeman, a University of Pennsylvania professor, will provide an up-to-date analysis of post-election data. and be joined in discussion by Bruce O'Dell on current status, next steps, and potential impact.

I just returned after spending four days there, part of the time with Bev Harris and some other fine election reform activists. I was one of the drivers "chasing" the van (driven by "Butch" and "Hoppy") and the police car that were picking up the boxes of ballots from various New Hampshire towns for the recount at the State Archive building. I witnessed some fascinating events and met some courageous, committed people, especially the Republican candidate who filed for the recount, Albert Howard.

Also there were Kathy Greenwell, chief source for the Bullitt County, Kentucky section of Bev's "Moonshine Elections" series; and Jeannie Dean, videographer extraordinaire from Sarasota, Florida (home of the 18,000 undervotes in 2006!) as well as Walter Reddy of Connecticut, creator of the election monitoring website "Liberty Broadcast Network" (.org), and Bob Schulz of "We the People Foundation", who filed the "National Clean Election Lawsuit" (NCEL) against all 50 Secretaries of State or Boards of Elections for allowing the use of electronic voting machines, in violation of the Constititution. We may get some of the players to call in tomorrow to help bring the coverage to life.
